This is a coverage that is necessary for any establishment that serves alcohol, although other establishments can benefit from assault and battery coverage.

Commercial liability policies typically do not cover incidents and losses resulting from assault and battery. An assault is an intentional act, not an accidental liability.

Assault is usually defined as "a threatening act, physical and/or verbal, which causes a person to reasonably fear for life or safety." Battery is generally defined as "the unlawful application of force to another's person; physical striking of another without permission."

As a full-service restaurant or foodservice industry provider, you are exposed to risk through assault and battery.

Restaurant owners are uniquely exposed to potential loss resulting from assault and battery.  In most cases, your general liability policy will face a claim after an alterncation occurs, but your policy alone will not suffice to cover all loss. Often, additional patrons or bystanders are injured during an altercation, and if alcohol is involved you will possibly face additional claims under your liquor liability policy in the event those patrons allege to have been overserved.
